Hi all,

I live in California and work for a federally funded non-profit. I’ve recently been notified that I’ll be placed on an unpaid one-month furlough starting next month. There’s also a strong possibility that this could lead to a layoff (RIF).

I’ve come across some information suggesting that it may be possible to use accrued PTO or sick leave during the furlough period to continue receiving pay. Alternatively, I’ve read that if I wait and am eventually laid off, I may receive a payout for any unused leave at that time.

Nonprofit Furlough: 2025 Shutdown Tips

The government shutdown which started on Oct. 15, 2025 has halted federal grant payments, hitting nonprofits hard with furloughs and fears of permanent cuts. Your furlough has an anticipated return date one month, but, unlike federal workers, you don’t get guaranteed backpay. Here’s some ways to prepare:

Your California Rights

Since your furlough has a set return date, it’s not considered a termination under California law, so you’re not owed immediate PTO payout unless it becomes indefinite or turns into a layoff (RIF). Here’s what you need to know:

  • Salaried (Exempt): If you are a salary employee and do any work (ex. answering even one email) in a week, you’re owed your full weekly pay. Nonprofits often enforce strict no-work rules to keep furloughs unpaid.
  • Hourly (Non-Exempt): You’re only paid for hours worked, so your furlough means zero pay unless you are asked to work.
  • Unemployment Benefits: You can file for unemployment through California’s EDD right away. Shutdown furloughs qualify.
  • Health Insurance: Your benefits should continue if your nonprofit keeps paying premiums. If not, you can switch to COBRA later.
  • Cal-WARN Act: If your nonprofit lays off 75 or more people at your site, they must give 60 days’ notice.
